Is United Merchant Services the same company as BLUU?
Summary
No. They are two companies selling under one brand. Bluu, Inc. makes the POS software and hardware, United Merchant Services, Inc. (UMSI) is the payment-services company, and UMSI holds an exclusive license from Bluu, Inc. to sell under the bluu name. Your POS contract is with Bluu, Inc., and card processing goes through a separate agreement with a processor the contract never names.
Which company a document means by "BLUU"
| Document | "BLUU" means | Covers |
|---|---|---|
| Privacy notice (updated August 10, 2026) | United Merchant Services Inc. and its subsidiaries and affiliates | Payment processing, equipment leasing and rentals, POS systems |
| Bluu Services Agreement and EULA | Bluu, Inc. and its affiliates, agents and subcontractors | Software license, devices, bluu Cloud, the U CHARGE gateway, the protection plan |
| Site footer | BLUU, "a registered ISO/MSP of Merrick Bank, South Jordan, UT" | The sponsor bank registration |
UMSI's name appears once in the services agreement, as the owner of the FlexGift gift-card trademark that BLUU uses under license. Card processing is defined as a Card Services Agreement between the merchant and a Processor, described only as the merchant card processor providing services to the merchant. You accept the services agreement by clicking Accept during installation or by continuing to use the software and hardware.
The two companies
Bluu, Inc. started in 2008 as United POS Solutions, Inc., doing business as UP Solution, and is based in Hackensack, New Jersey. The company introduction credits UMSI with nearly three decades in payments and cites the Nilson Report (Issue 1215, March 2022), which ranked it 48th among U.S. merchant acquirers. The privacy notice lists "United Merchant Services, Inc. or Bluu, Inc" at the same Hackensack address.
What the agreement prices and what it leaves blank
Device fees, the bluu Cloud monthly fee, U CHARGE gateway fees, a monthly web access fee and a statement fee all belong to the cover page, so the agreement itself carries no amounts for them. The Cloud fee is not prorated and follows BLUU's or the reseller's current price schedule. BLUU or the processor can change pricing on 30 days' notice. Device sales are final with no returns outside the protection plan, and the software is licensed, not sold, with no refunds.
The protection plan is the one item with a price in the agreement:
The Point 3 promotion
The bluu Point 3 terminal promotion priced the device at $1 plus sales tax on a 12-month term, with a $195 early termination penalty if the account closed within 12 months. It ran until August 31, 2026. The page says new merchants signing up from September 1, 2026 pay the original pricing, and that price is not listed. No card processing rate appears anywhere on ebluu.com.
